StartToPivot LLC (“StartToPivot”, “we”, “us”, or “our”) specializes in providing web development, business consulting, and digital strategy services, including but not limited to:
• Website design & development
• SEO optimization & digital marketing
• E-commerce integrations
• Business process automation
• Consulting on digital transformation
By using our services, you (“Client”) agree to the terms outlined below.
a. Standard Payment Structure
• A 60% deposit is required before work begins.
• The remaining 40% balance is due upon project completion, before the final delivery or launch of the product.
b. Full Upfront Payment (At Our Discretion)
• Depending on the scope, timeline, and complexity of the project, we may require full payment upfront before beginning work.
• This will be determined on a case-by-case basis and communicated before project initiation.
c. Payments via Affirm
• If a client chooses Affirm financing, the full payment is required upfront before project initiation.
d. Late Payments & Fees
• Failure to make payments on time may result in project delays, suspension of services, or additional fees.
• All custom-developed websites, software, branding, and digital assets created by StartToPivot belong to the client upon full payment.
• Third-party assets (e.g., stock images, licensed software, plugins) remain subject to their respective licensing agreements.
Clients are responsible for:
• Providing accurate and timely content, approvals, and required materials (logos, images, text, etc.).
• Ensuring compliance with industry regulations related to their business operations.
• Maintaining their website post-delivery unless a maintenance plan is agreed upon.
StartToPivot is not responsible for delays caused by late client submissions.
By opting into StartToPivot services, you consent to receive text messages regarding:
• Project updates, service alerts, and promotional offers.
• Clients may opt out at any time by replying “STOP” to any message.
StartToPivot is not responsible for:
• Issues arising from third-party services, hosting providers, or software integrations.
• Loss of data, security breaches, or website downtime after the project is handed over.
• Any direct, indirect, or incidental damages resulting from the use of our services.
Clients are encouraged to maintain regular backups and security measures for their websites.
We may integrate third-party tools, APIs, and plugins for enhanced functionality. However:
• StartToPivot does not own or control these third-party services.
• We are not liable for service outages, policy changes, or disruptions caused by these providers.
Clients should review the terms of service of third-party vendors used in their project.
• Payments made for services are non-refundable once work has begun.
• If a project is canceled before significant work has started, a partial refund may be considered at StartToPivot’s discretion.
• StartToPivot LLC does not sell, share, or distribute your personal data to third parties.
• Personal information is only collected for service fulfillment, communication, and project management.
• Clients are responsible for ensuring their websites comply with GDPR, CCPA, or other applicable data protection laws.
• This agreement shall be governed by the laws of the State of Maryland.
• Any disputes shall first be attempted to be resolved through good-faith negotiations.
• If unresolved, disputes shall be settled through binding arbitration in Maryland.
StartToPivot reserves the right to modify these Terms of Service at any time. Clients are encouraged to review updates periodically.
